123ENVIALO.COM' SERVICE IS SUBJECT TO THE FOLLOWING TERMS AND CONDITIONS:
FEES, PAYMENT, AND CURRENCY EXCHANGE
FEES. In order to complete of the a money transfer, you agree to pay 123envialo.com a fee for each transaction you authorize at the applicable rate then in effect. The applicable transfer fee for your transaction will be provided to you in the summary page prior to your final authorization of the transaction.
CURRENCY EXCHANGE. All payments will be made in US Dollars. Foreign currencies are converted to US Dollars at the exchange rate set by Banco Nacional de Cuba on a daily basis. This rate will be competitive and very similar to the exchange rate applied by the most financial institutions elsewhere in the world. Consequently the principal amount received in Cuba might slightly differ from the amount you actually sent.
PAYMENT. All transfer fees and the principal amount are due and payable before 123envialo.com processes the transaction. Payment can be made by bank (credit or debit) card. If we do not receive authorization from your credit card, the transaction will not be processed and funds will not be transmitted to the recipient. You will be notified by email when your transaction is completed. Each time you use our service you are asked to authorize 123envialo.com to charge your designated credit card account for the principal amount and the transfer fee.
Charges against your credit or debit card could be requested in currencies other than USD, as Canadian Dollar, Euro or Mexican Pesos. This fact, as well as the details associated with the charges that will appea in your statement, will be always clearly stated in our website, before you complete any online payment, in order to allow you to accept or not that charge. Due to the exchange rate applied when converting USD to/from other currencies, which varies on a daily basis, there could be a difference between the transfer specified USD amount and the final amount that will be deducted from the card. The rate applied by your bank is unknown to us. Your bank might also charge an extra amount due to currency exchange operations. This will only depend on the agreement you have with your bank, or Credit Card Company. Therefore, the total amount that will be deducted from your card cannot be calculated or informed to you in advance.
AIS Debit Card is offered free of charge in Cuba to any person who can provide a valid identification. The debit card holder has the option of setting a maximum daily expenditure limit, which helps to protect him/her against fraudulent operations in case of losing the card. The AIS Debit Card is issued for the internal use in Cuba only. 123envialo.com is responsible for crediting the principal amount within 48 working hours after the approval of the transaction. Recipients can withdraw part or all of the funds at any time, or make purchases of goods and services in stores where our card is accepted. The sixteen digits number of the AIS Debit Card is the reference number of the beneficiary. 123envialo.com denies any responsibility in case you enter this number incorrectly. An ID will be required when using the card for withdrawal or payment. AIS Debit Card pays or receives no interest for money kept in AIS Debit Card.
CHARGE BACK POLICY.
In the event that a credit card holder claims he/her has not transferred money to a person in Cuba, 123envialo.com will incur in a charge back and the beneficiary will be responsible for the amount transferred, our applied service fee, any charge back fees from the bank , and our cost to process a charge back. 123envialo.com will return the funds from the BENEFICIARY and credit the principal amount plus our applied fee back to the credit card holder. The BENEFICIARY will be subject to the local credit card fraud law as being the beneficiary of a credit card fraud. If 123envialo.com receives the total amount back within 15 days after the credit card holder’s claim, the recipient shall not be subject to legal action.
US CITIZENS OR RESIDENTS
All individuals subject to US jurisdiction must read and understand the terms and conditions of the affidavit which regulates money transfers of US citizens and residents to their relatives in Cuba. When you use 123envialo.com’s money transfer services, you agree to the OFAC regulations concerning money transfers to Cuba.
When you sign up for the 123envialo.com Recurrent Transfers service, you agree to pay 123envialo.com a fee for each transaction at the applicable rate then in effect minus a 10% discount of this rate for the period of time and frequency you specify. The principal amount, frequency, date of transfer, and discounted transfer fee will be provided to you in the summary page prior to your final authorization of the Recurrent Transfers Contract.
LIMITATION OF LIABILITY. IN NO EVENT SHALL 123envialo.com BE LIABLE FOR DAMAGES DUE TO DELAYS, NON-DELIVERY, NON-PAYMENT OR UNDERPAYMENT OF ANY GIVEN MONEY TRANSFER, WHETHER CAUSED BY NEGLIGENCE ON THE PART OF ITS EMPLOYEES OR AGENTS OR OTHERWISE, BEYOND THE SUM OF $300 (in addition to refunding the principal amount of the money transfer and all fees). IN NO EVENT WILL 123envialo.com BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES. THESE CONDITIONS CANNOT BE CHANGED OR SUPPLEMENTED ORALLY.
